Drunk Driver Kills 12-Year-Old Girl in Elroy | Shapiro, Washburn & Sharp

What Happened:

A young girl was searching for her cell phone in Elroy, North Carolina (NC). After the phone was found, the 12-year-old girl and her best friend decided to hang around the intersection of Powell Road and Highway 70 and throw eggs at cars. The young girl dropped her cell phone and when she leaned down to pick it up, she was hit by a drunk driver.

According to WNCT, the impact was so strong that the girl’s body was thrown approximately 110 feet down the highway. Her body was dragged out of the road by her best friend to prevent her from being hit by another car. The girl suffered critical injuries including brain damage, a broken femur and ankle. She did not survive the trauma and passed away.

The authorities arrested the driver of a F-150 pickup truck and charged him with a DUI.

Our deepest sympathies go out to the victim’s family. Losing a loved one is extremely painful and traumatic, but the pain is made even worse when the loss is sudden and the victim is so young.

The North Carolina Injury Lawyer’s Perspective:

The victim’s family may have grounds to pursue a wrongful death claim. It’s frustrating to think that, had the driver been sober maybe this tragic accident could have been avoided. Though, the defense would be that the young girl was partially at fault for deciding to throw eggs. Nevertheless, the family should speak to a North Carolina wrongful death attorney to determine what legal options may be available to them.
