Fauquier County, VA Car Wreck Causes Death of Mother, Child | Shapiro, Washburn & Sharp

A husband and wife and their 8-year-old son were enjoying a ride in their Toyota Avalon sedan when tragedy struck. The driver of a Toyota pickup truck swerved into their lane on Vint Hill Road near Route 652 in Fauquier County, Virginia (VA), and slammed head-on into the family’s car.

The child and his mother were both killed despite wearing seat belts, according to nbcwashington.com.

Our deepest condolences go out to the husband. As someone who has been married for more than 20 years and has two children of my own, the thought of losing any member of my family in a sudden accident is heartbreaking. I hope the husband is able to pick up the pieces after this terrible accident and push forward in this trying time. Virginia State Police have stated that alcohol and speed did not appear to be factors in the awful car-truck crash. This leads to the obvious question of what caused the at-fault truck driver to suddenly swerve into the other lane. Was he driver distracted in some way, or was there a mechanical issue? We will have to wait to see what the investigation determines regarding the cause of this accident.

If it turns out the at-fault driver was distracted for some reason (e.g. texting while driving), then the husband may have grounds to pursue a wrongful death claim.
