Huntington WV Woman Suing Door Company for Car Accident Injuries

A woman from Huntington WV is suing a local door company for the injuries she sustained in a car wreck.

On May 24, she was driving on US 52 when she alleges her car was struck by a delivery van owned by Varney Door Company. Because of the crash, the woman suffered broken bones and a concussion. She is suing the company for pain and suffering, medical expenses and lost wages.

Our experience as personal injury lawyers tells us that these cases are not always as clear as you might think. When a commercial vehicle hits a car, you naturally assume that the company that operates the truck must compensate the victim of the crash for their injuries. It is not as simple as that. Some companies do hire drivers as direct employees, which gives them protection under that firm’s liability insurance. Other companies hire their drivers as independent contractors.

If the accident victim is hit by a commercial vehicle driven by an independent contractor, getting compensation for injuries can be complex. Independent contractors, of course, need to have to have liability insurance, but the insurance policy on the driver alone may not provide enough compensation. And if the driver is an independent contractor, the accident victim cannot make a claim against the company’s insurance policy.
