A man in Casper IN who rear ended a biker, which broke the man’s back and left him with a serious brain injury, has been sentenced to two years in jail for the 2014 hit and run.
The man was sentenced last week, having been charged with reckless driving, driving with a suspended license and leaving the scene of an accident that caused injury.
As personal injury attorneys serving North Carolina and Virginia, we have seen far too many preventable accidents that led to a biker being injured or killed. According to the CDC, 1% of all trips in the US are on a bike, but still, 800 fatal bike crashes occurred in 2012. One of those crashes occurred in North Carolina where a truck driver fell asleep behind the wheel, leading to one death and four other bikers with serious injuries.
In Virginia alone, 11 people died in bike accidents in 2012. Unfortunately, many of the surviving families only are satisfied by the guilty driver serving time in jail. In a case involving driver negligence such as hitting a biker, the car driver should have to pay financially as well. The surviving family or injured biker is usually entitled to financial damages, which can include lost wages, loss of consortium, pain and suffering, medical costs and more.
