Seventh Wrongful Death Case Out Of Court by Massey Energy | Shapiro, Washburn & Sharp

Massey Energy Company, a mining company based in Richmond, Virginia (VA), has settled another wrongful death case following the Upper Big Branch mine disaster in West Virginia (WV) last spring. Some information on the legal settlement was outlined in the company’s annual report.

While the details aren’t known, the company has said that it was offering $3 million to the families of those who lost loved ones in the blast which killed 29 miners and injured two others: the worst mining disaster in the country since 1970. So far, the company says that it has settled seven wrongful death cases and has gotten three approved by the court. A personal injury lawsuit from one of the surviving miners is also being handled.

Currently two other families are headed to court with wrongful death lawsuits regarding the tragic mine explosion. In addition, a criminal investigation is also under way.
