What Happened:
A car hit a motorcycle driver at the intersection of Old Forest Road and Hill Street in Lynchburg, Virginia (VA). The driver of the car was reportedly turning left onto Hill Street when she hit the motor bike operator. The impact was strong enough to send the motor bike operator flying 40 feet, according to wset.com.
The car also slid against a school bus. Fortunately, no children on the school bus were hurt. Unfortunately, the operator of the motor bike suffered serious injuries and is currently in critical condition.
The driver of the car has been charged with failure to yield.

Based on the information available, it appears as though the driver of the car was negligent and her reckless behavior was the proximate cause of this awful wreck. Police have charged the driver, but just because the driver is facing criminal charges does not mean the motor bike operator is precluded from seeking damages through a personal injury claim. If the motor bike operator is forced to miss a significant amount of time from work, accrues a large amount of medical bills, and/or suffers a decrease in their quality of life, then they can seek restitution for those damages.
