Norfolk, VA Accident Leaves Pedestrian Seriously Injured | Shapiro, Washburn & Sharp

Just after midnight on March 8, 2012, a car struck and seriously injured a pedestrian at the intersection of East Ocean View Avenue and Chesapeake Boulevard in Norfolk, Virginia (VA). According to WAVY-TV 10, the crash occurred in an area where construction is being done, and the man rushed to Sentara Norfolk General Hospital after the collision was walking outside of a nearby crosswalk.

Police continue to investigate the accident and have not filed any charges against the at-fault driver. Because the injured man was in the roadway, charges are actually unlikely unless evidence is found that the person behind the wheel of the car was impaired by drugs or alcohol, speeding or distracted in some way, such as by using a cell phone.

As a Virginia personal injury attorney who has helped many victims of pedestrian accidents receive compensation to cover medical expenses and lost wages, though, I know that criminal charges are not required to hold drivers liable for the injuries and damage they cause. And while using a crosswalk should also be a priority for every pedestrian, there are times when road conditions such as ongoing construction make doing so impossible.

Regardless of whether this accident could have been prevented through actions of the drivers or the man on foot, I wish the injured victim a speedy recovery.
