What Happened

On New York Avenue in Northeast Washington, police reported a pedestrian was hit and killed by a car on February 13, 2012.

The Virginia Personal Injury Lawyers’ Perspective

It’s always disconcerting to hear of a loss of life. Even though the accident took place outside of a crosswalk the pedestrian still has rights that need to be defended. It’s sometimes assumed that if a victim is not in a crosswalk when he or she is hit then the driver of the vehicle is not to blame, however that is not always the case. Under common law in Virginia (VA) and in many other states, a pedestrian has a right-of-way after they have performed their duty to lookout for motor vehicles at a street corner and when crossing the road under circumstances where a car/auto driver has a clear view of the pedestrian. This is why it’s important to contact a Virginia (VA) wrongful death lawyer familiar with pedestrian and crosswalk law. Our wrongful death attorneys can provide a confidential analysis of your legal options. Not every accident mandates an automatic wrongful death claim, but if the evidence proves the driver was negligent we will do everything ethically in our power to pursue justice.
