Police Investigate Mine Worker’s Death in Vehicle Accident In West Virginia | Shapiro, Washburn & Sharp

The Associated Press reports that both the West Virginia Office of Miners’ Health, Safety, and Training, and the Federal Mine Safety and Health Administration are investigating whether the recent fatal accident at a West Virginia Patriot Coal Mine is mining-related.

On Jan. 28, 43-year-old Darrell Massey, a contract worker, was killed in a vehicle rollover. The fatal accident took place when the man was driving home after work on a haul road, lost control of his vehicle, and went over a embankment. The location of the car accident was at Patriot’s Winchester mine in Kanawha County.

Whether or not the accident is listed as mining-related or not mining-related will affect the year’s mining safety statistics – so far this year, no one has been killed on the job in the United States. It is unclear whether this designation would affect any lawsuits concerning the man’s death or whose insurance companies will be involved in the coming days and weeks.
