Reckless Driver in Henrico Causes Fatal Accident | Shapiro, Washburn & Sharp

What Happened

Josh McDaniel, a 25-year-old Mechanicsville, Virginia (VA) native, was riding along North Laburnum Avenue in Henrico when he reportedly fell off of his vehicle. Several cars stopped in the right travel lane so Mr. McDaniel would have some room to get up and collect himself.

Unfortunately, a driver made the reckless decision to bypass the stopped cars and wound up running over Mr. McDaniel. He suffered fatal injuries as a result, according to the Richmond Times-Dispatch.

The at-fault driver faced criminal charges and subsequently received a 30-day suspended sentence and was fined $250.

The Virginia Injury Lawyers’ Perspective

Our deepest sympathies go out to the McDaniel family. Losing a loved one is never easy, but it’s especially painful when the loss is sudden and unexpected. This particular accident is especially egregious since the at-fault driver made the conscious decision to disregard the vehicles that were already stopped on the road in recognition that an accident, or problematic situation, was ahead.

Members of the McDaniel family should consider contacting a Virginia wrongful death law firm to discuss the legal options available to them. Just because the at-fault driver has been sentenced in a criminal court does not preclude the family from pursuing justice through a wrongful death civil claim.
