Even as an experienced Virginia personal injury attorney there are still some news stories that elicit an audible response from me as I read them. This was one of those stories. Three children were injured in McDowell County, Virginia (VA) when a coal truck smashed into the church bus they were riding on. How in the world did the driver of the coal truck not notice a bus full of children? Well, that's what happens when you drive a 10-ton truck drunk.
The driver is now charged with DUI causing bodily injury, reckless driving, failure to maintain control, defective equipment, and DUI causing property damage. Drunk driving is an epidemic on the roads of Virginia (VA). But this is a new low even for a drunk driver. Operating such a large heavy vehicle while impaired is a new level of negligence that could have ended much more tragically.
