What Happened:

On Interstate 64 (I-64) in Hampton, Virginia (VA) a distracted tractor-trailer driver slammed into a VDOT work truck.  The driver saw the work truck at the last minute and tried to swerve.  The truck lost control after striking the truck, flipped over and caught on fire.  The driver of the big rig was trapped in the fiery wreck and was saved by a VA state trooper and good Samaritan.  Both the driver of the VDOT truck and the tractor-trailer were injured

The Virginia Injury Lawyer’s Perspective:

As an experienced Virginia (VA) truck injury attorney I applaud the quick response of the VA state trooper who pulled the truck driver to safety.  Although the tractor-trailer driver didn’t mean to cause the accident when he leaned over to grab his water bottle, he and his insurance company are still accountable.  Proceeding only against the truck driver is not the only course of action, when a trucker is driving for his employer, the employer is automatically responsible.  The driver was charged with reckless driving which makes the driver responsible for any negligent or careless conduct as well.
