Virginia Truck Company Settles Wrongful Death Case After Crash | Shapiro, Washburn & Sharp

The second wrongful death lawsuit to come out of a fatal 2009 truck crash in Woodstock, Virginia (VA), has been settled between the administrator of the victim’s estate, the truck driver and the company that operated the vehicle involved in the crash. The suit was filed on behalf of the estate of 27-year-old Hilario Guox Vicente. Settling for a total of were defendants Troxell Thomas Miller, the driver who lives in West Virginia (WV), and trucking company Pitt Ohio Express.

At the end of 2010, the defendents paid $625,000 to settled the wrongful death case involving the other person to die in the car crash, 35-year-old Ramiro Vicente-Atjun.

The fatal accident took place on the southbound lanes of I-81 when the tractor-trailer slammed into the rear of the victims’ compact car, leaving both men dead at the scene. The truck driver was charged with misdemeanor improper driving and fined $500. As part of the wrongful death settlements, the trucking company did not admit liability in the big rig wreck.

Vicente’s four-year-old daughter will receive the settlement monies  in installments over the next 40 years.
