What Rights do ATV (All Terrain Vehicles) Have When Injured in a Car Accident?

What Happened:

In Chilton County, Alabama (AL) a crash occurred between an all terrain vehicle and a tractor trailer on AL Hwy. 143 just north of County Road 68.  The driver of the ATV was killed in the accident and the reason for the crash is not immediately known.

As an experienced Virginia (VA) truck injury attorney I’d like to first offer my condolences to the family of the all terrain vehicle driver.  Although in Virginia (VA) accidents between ATV and tractor-trailers are rare ATV accidents, injuries and fatalities are not.  There have been 211 ATV deaths in Virginia (VA) over the last decade.  Virginia law states that ATV use on public highways is prohibited, except to cross these roads, for agricultural purposes, or while in Buchanan County.  If you were injured while crossing a road on an ATV and you followed all traffic laws and regulations you may be able to seek compensation for injuries.
