Case Description: Falling shelf at store
Type of Injury: Injured shoulder requiring two surgeries
What Happened: Plaintiff was a customer in a Maxway store in Murfreesboro, North Carolina when a metal shelf fell down striking her in the shoulder. The incident was reported to the store’s management immediately. Plaintiff alleged that the shelf was not properly secured. One eyewitness was identified.
The injured person suffered a right shoulder AC separation and tear of the rotator cuff. Our client sought treatment which ultimately resulted in two surgeries on her shoulder. The exact amount of medical bills attributable to the accident was contested but was in the 10's of thousands of dollars.
Outcome: Settled for $120,000.00
Key Legal Strategy: John C. negotiated the case directly with in house counsel for the defendant company. We interviewed the doctor who had performed the surgeries to confirm what opinions he had as to what of her injuries and surgeries were caused by the accident. Negotiations also involved getting the health insurance company for the client to agree to a compromise of the amount of money it had to be paid back for the medical care received and claimed in the case. This increased the money in the client’s pocket at the end of the case.
