What happened:
This case involved a hit and run accident. Our client and her husband were headed out to go hunting early in the morning. On the way out of their hometown, the defendant, likely drunk, ran into them head-on. The defendant then fled the scene on foot and was never found by police.
Our client suffered a severe shoulder injury requiring two surgeries.

Our firm conducted a very thorough investigation which revealed the defendant’s identity. The defendant happened to be in prison for other charges. The defendant was driving a friend’s car at the time of the wreck. The insurance company for the vehicle owner refused to pay anything voluntarily because no one could actually place the defendant in the car at the time of the wreck. Furthermore, they argued that the defendant was an un-permitted user so coverage would not apply.
Outcome:
Despite the position taken by the liability carrier, we convinced the under-insured motorist carrier to pay up. Our client was smart enough to carry adequate coverage on her own policy and we were able to settle the case for $225,000.00.
