My colleague wrote about a recent attempt to secure a new trial on appeal by Norfolk Southern (NS) defense attorneys after a West Virginia jury awarded an injured worker $3.4 million. The NS lawyers argued that the judge in the case read the jury instructions incorrectly which wound up effecting the decision.
