ATV Accident in W. VA Kills Woman | Shapiro, Washburn & Sharp

A woman was killed in an ATV accident on Saturday night, January 22nd, 2011, in Jackson County, West Virginia (W. VA). The man considered responsible for the accident was arrested.

According to Jackson County Sheriff’s Chief Deputy Tony Boggs, the 37 year-old ATV driver was arrested on DUI charges after the vehicle flipped on its side, killing a 47 year-old passenger. The driver is being held at South Central Regional Jail.

The accident occurred on Poverty Ridge near Ripley, off Route 21, at approximately 8:30 p.m. in the evening. Emergency crews were called in shortly, but could do nothing to revive the victim.

Our hearts go out to the family and friends of the innocent victim. It was a terrible accident to happen to such a beloved person. A friend of the deceased described her as “one of a kind, a unique and beautiful spirit [who] was always positive.” Another stated that “[the victim] loved her daughter, and was always thinking about her and her future.”

It cannot be stated often enough how people must not drink and drive. If you know that you will be indulging in alcohol, chose a designated driver to take you home that evening. Certainly do not choose that night to get involved in off-road sports, such as driving an ATV. You see the results of what happen when you do.

If someone you love was killed by a drunk driver, discuss your case with an experienced wrongful death attorney as soon as possible.
