Brian Center Nursing Home Goes to Trial for Neglect

On June 24, 2014, four officials of the now defunct Brian Center nursing home in Scott County were indicted by a federal grand jury on racketeering and healthcare fraud charges. The trial for the case of suspected fraud and neglect at the former nursing home began this Monday, January 5, 2015.

Residents were living in deplorable conditions. Patients allegedly suffered poor nutrition and very unsanitary conditions. The staff was alleged to have failed to bathe, clean, turn and feed the patients. Bed sores were aggravated from neglect.

Brian Center received a federal inspection from the Department of Health and Human Services Office of Inspector General, IRS Criminal Investigations, the Virginia Attorney General's Medicaid Fraud Control Unit and the Department of Labor's Employee Benefits Security Administration.

The inspection revealed a myriad of issues. As a result of one such issue, a patient with dementia broke her hip after being left unattended in a bathroom. Another patient developed deep tissue pressure sores before being treated by nursing home staff.

Our firm is staffed with attorneys who are expertly equipped to handle nursing home abuse cases. If someone you love is in a nursing home and you suspect abuse, it is important to contact an attorney right away. Though it is reprehensible, poor nursing home facilities and their staff are able to take advantage of the elderly without having to worry about the patients fighting back.

This is why anyone who knows someone suffering nursing home abuse must speak up. The patients subject to the abuse of a nursing home facility do not otherwise have a voice. Our firm fully supports the plaintiffs of the trial going forth, and we hope justice is properly served.
