The North Carolina Personal Injury Lawyer

If you are unfortunate enough to be involved in a pedestrian accident, which was not your fault, then you may be entitled to make a personal injury compensation claim. If you are knocked down on the pavement by a moving vehicle, or struck by a vehicle when you are on a pedestrian crossing, you are likely to have a very strong claim. This does not however mean if you were struck outside of a crosswalk you have a weak claim. There are few things to keep in mind to determine the strength of a possible claim. The first thing to know about a personal injury claim is exactly that fact; it is a personal injury claim. There must be a legitimate injury involved, a near miss is not worthy of pursuing a claim. The second factor needed to be proved is negligence; the injury must result from negligence of the driver. When drivers have an unobstructed view and can see a pedestrian in the road way at a distance, they must take the duty of care towards pedestrians. If a driver can prove that he was not negligent behind the wheel, the claim will most likely fail. The last factor is liability; the cause of the accident may not always be obvious. In most situations there is only one party to place the blame on; however it is possible for more than one factor to contribute to the accident.

If you have been injured in a pedestrian accident we strongly urge you to contact a North Carolina (NC) personal injury lawyer to discuss your legal options. If the evidence surrounding your accident proves that you were a victim of negligence, there may be a strong case for a personal injury claim. We have established an excellent track record and delivered many clients the restitution they deserve.
