We are saddened by news that 31 year-old Crystal McDaniel of Gastonia, North Carolina was killed this Mother's Day as she walked with one of her children along Myrtle School Road on the west side of Gastonia around 2:40 p.m.
McDaniels, a married mother to five children, was on her way to her mother's house with one of her daughters for Mother's Day. The driver of a 2013 Toyota Corolla was heading north on South Myrtle School Road when he left the roadway, striking McDaniel, who was walking with her daughter to the side of the roadway. The driver continued to travel off the roadway and collided with a natural gas line in the rear of 700 South Myrtle School according to police.
A witness said the driver nearly hit McDaniel's daughter as well. The victim's aunt says the victim's daughter had to jump out of the way to avoid being hit but witnessed her mother lose her life.
Police said the driver might have had a medical emergency that caused him to lose control prior to striking McDaniel and that no charges have been filed against him at this time.
Gastonia police are still investigating the crash. They did take a blood sample from the driver of the vehicle and have said that they will test it. In several reports since this accident, McDaniel’s family members have said they want a comprehensive investigation. However, the police said they are not releasing any more information about the driver or his condition.
This is an extremely tragic situation for the family of the deceased and it is understandable that they are still in pain and want answers. We send our condolences to them for the loss of their loved one, especially on a day meant to honor our mothers who are so important to all of us.
We agree with the family and hope the police conduct a full investigation. A wrongful death lawsuit may be appropriate in this case as wrongful death suits are intended for situations where a death has occurred at the hands of another due to his misconduct or negligence. As the family indicated, more information is needed about the driver's medical conditions and the state in which he chose to get behind the wheel. We have handled cases like this and helped families receive monetary compensation for the loss they suffered, including funeral expenses and burial expenses and emotional damages.
If a loved one has passed and you believe a wrongful death claim is appropriate it is important to contact a law firm with experience in this area of the law.
