Losing a loved one in a work place accident can cause emotional and financial pain for years to come. Our lawyers understand how difficult it is to come to grips with filing a wrongful death suit after a death in the workplace. It's important to keep in mind that waiting to file a claim could affect your legal rights. In all matters involving a wrongful death it is important that actions be taken promptly to preserve evidence, investigate the accident in question, and to file a lawsuit prior to the deadline stated by the statute of limitations. The statute of limitations is a limited period of time in which you can take legal action. In Virginia (VA), the statute of limitations for a wrongful death lawsuit is only two years. If a claim is not filed within this time period, the decedents lose the right to file a wrongful death claim.
