A Mason County, West Virginia widower has filed a lawsuit against the nursing home facility that cared for his deceased wife. The lawsuit was filed June 16 in Mason Circuit Court against Pleasant Valley Hospital, Inc. It alleges that the facility engaged in negligence of his wife, which led to her death.
The complaint alleges that from Dec. 21-22, 2012, the nursing home improperly cared for the elderly woman. It states that the woman had respiratory failure and cardiac arrest after she fell. According to the suit, the nursing home did not monitor her condition carefully.
Court documents state that the defendant’s negligent actions contributed to the woman’s injuries and subsequent death on Dec. 22.
The husband is seeking compensatory and punitive damages, as well as for his and his wife’s pain and suffering.
Nursing home staffs work hard, but sometimes they are not able to appropriately monitor the condition of all their patients. Neglect and even abuse in nursing homes can take on many forms:
· Preventable falls and other injuries
· Physical assault
· Failure to provide care
If your loved one has suffered inappropriate care in a nursing home, be certain that you carefully document the case. That way when you bring a legal claim, you can more easily prove your case in court.
