My law partner John C. and I recently tried a case to jury verdict in Virginia Beach, Virginia. We faced State Farm and one of the main defense doctors in town named Felix Kirvin, an orthopedic surgeon. It is very hard in this day and age to get good results in what the insurance companies call “soft tissue” injuries. This means that the client did not have a broken bone or a clear injury that you could point to on an MRI. Rather what was hurt were the connective tissues of the neck and back like muscles, ligaments and tendons.
