Montana Railroad Derailment Injures Two Railroad Employees | Shapiro, Washburn & Sharp

The impact of the crash was heard for miles on a still, frigid night in Milton, Montana.  The boom that frightened residents and shut off power for thousands was the result of a railroad collision.  A westbound train plowed into the back of a eastbound train derailing three railroad trains and 10 empty grain railroad cars.  The railroad accident left two Montana Rail Link employees injured after the front of their railroad engine was crushed by the impact.

As experienced Virginia (VA) and North Carolina (NC) railroad/FELA attorneys it has been our privilege to represent trainmen, brakeman/conductors, engineers, signalmen, machinists, maintenance-of-way-workers and railroad dispatchers that have been injured by negligence as a result of poor safety standards.  As a result, our firm is well known to thousands of railroad workers and fellow injury attorneys throughout the eastern region of the United States as a highly qualified law firm in the area of railroad injury law.

After a railroad accident resulting in derailment many railroad workers are led to believe that if they are hurt then they are automatically entitled to compensation. Most railroad claims agents will tell an injured railroad worker that compensation is simply a percentage of the time or wages lost, but this is totally false. Railroad workers are protected by the Federal Employers’ Liability Act, or FELA, which provides that workers can settle with, or sue their own railroad employer and FELA permits a jury trial if desired. A jury may award past and future lost wages, past or future medical expenses not covered by the employer’s health insurance, pain and suffering, permanent impairment, and other damages.
