The Virginia Injury Lawyer’s Perspective:

As an experienced Virginia (VA) car accident attorney I know that crossing the road even at a crosswalk can be dangerous.  One reason is that many drivers these days are driving distracted and may not see or pay attention to a pedestrian, even if the pedestrian does have the right-away.  Believe it or not studies show that on a per-mile basis walking is more dangerous than driving.

So what rights do pedestrians in Virginia have?  Well, the law reads that “The driver of any vehicle on a highway shall yield the right-of-way to any pedestrian crossing such highway at any clearly marked crosswalk, whether at mid-block or at the end of any block.”  The family of the man that was killed may have the right to recover by filing a wrongful death claim if it is found that the driver was negligent.  As experienced Virginia (VA) pedestrian injury lawyers we have a proven track record of recovering for our clients.  We recovered $540,000 for two clients after they were struck by a car in a crosswalk at the Virginia Beach, VA, oceanfront.  Even more horrific was the hit and run by a drunk driver of a student as she was lawfully walking beside a road.  We were able to recover $300,000 for her injuries.
