The Virginia Personal Injury Lawyers’ Perspective

Police did not immediately charge the van driver with any traffic violations. Despite that, as personal injury attorneys who have helped many injured pedestrians in Norfolk, we know that the at-fault driver could still be held liable for the harm caused to the victim of the accident in Ocean View. If the injured man was crossing at a corner or  walking in a crosswalk or on a sidewalk, he would have had right of way that the driver would legally have to grant. The driver would also be liable for the pedestrian’s injuries if the van was exceeding the posted speed limit, out of its lane of travel or being operated in an unsafe manner.
