According to NBC12, there is a dispute over whether the at-fault driver was actually intoxicated or suffering from a health issue.

The driver had been suffering from high blood pressure and headaches, along with blurry vision in the days leading up to the accident. His wife thinks these problems, rather than the alcohol he consumed, may have caused the accident.

Even if the driver was actually suffering from a health ailment and not over the legal limit for intoxication does not change the fact that he caused a serious car accident and injured innocent children. The law still recognizes liability if a driver knew he or she was suffering a health issue that would impair driving but still got behind the wheel.
