U.S. Supreme Court Upholds Railroad Employees’ FELA Injury and Wrongful Death Protections | Shapiro, Washburn & Sharp

In his latest post to our firm’s Norfolk Injuryboard blog, my fellow railroad injury and FELA plaintiff’s attorney Rick Shapiro declares the 5-4 U.S. Supreme Court decision in favor the defendant in CSX Transportation v. McBride as a major victory for all rail employees. The decision, written by Justice Ruth Bader Ginsburg, upholds decades of legal precedence in holding rail companies such as CSX, Norfolk Southern and Amtrak liable under the Federal Employers’ Liability Act, or FELA, for any employee’s injury, illness or death that can be shown to have been caused, in any part, by negligence of the railroad.
