Virginia (VA) Medical Malpractice Award Caps Upheld by Governor | Shapiro, Washburn & Sharp

In his latest post to our firm’s Norfolk Legal Examiner, my colleague Rick Shapiro excoriates Virginia Gov. Bob McDonnell for vetoing a bill that would have gradually raised the state-mandated cap on damage awards in medical malpractice cases. Rick urges lawmakers to either override the veto of H.B. 1449 or to reintroduce the legislation when they next convene in 2012 in order to protect victims’ rights. He also explains why the present or new cap itself is unconstitutional.
