West Virginia Crash Kills Man in Wheelchair | Shapiro, Washburn & Sharp

Derris Scott, 68 was killed over an accident when his motorized wheelchair was struck by a tractor trailer in Kenova, W.V.  Scott was knocked to the ground and was dragged for up to a quarter mile.  According to Kenova police chief Bob McComas, it seems the driver of the truck, Michael Joyce never saw Scott crossing the intersection and did not even realize the collision had occurred until another motorist flagged the truck down.

There was no time to send Scott to the hospital anymore for he immediately died on the accident scene. Joyce will be charged accordingly and will have to face the consequence of his negligence.  It could not be determined if he can provide himself a lawyer.

Negligent driving may often result when a driver is distracted.  May it be because of texting while driving, talking on the cell phone, or the driver is simply not paying attention on the road and the task that he is doing.  According to an article from www.negligentdriving.com, brain power used while driving decreases by 40% when a driver listens to conversation or music. More than 80% of drivers admit to blatantly hazardous behavior: such as changing clothes, steering with a foot, painting nails and shaving.  The best defense against these unsafe drivers is to drive alertly, stay within the speed limit and wear you safety belt.  As a driver you should always be cautious and aware of any pedestrians especially in busy areas.
