What happened:

A 78 year old Canadian woman was killed in a car wreck when the vehicle she was riding in spun out of control and went off the road after an encounter with another vehicle.  The accident occurred on U.S. 52 North in Surry County, between the Pilot Mountain and Cook School Road exits.  According to a report in the Winston-Salem Journal, the woman and her family were returning from a wedding, driving along the northbound lane, when they got stuck behind a slow moving black Dodge Durango. The 70 year old family member who was driving the Buick SUV the victim was in told police that as he attempted to pass the Durango, it sped up and this began a pattern of the Durango’s driver speeding up and then slowing down.

This pattern continued for about a mile until the SUV’s driver realized that the two cars were reaching speeds of about 80 mph. He slowed down, but then realized that the Durango was now cutting into his lane and the SUV drove off the road to the right. As the driver over-corrected, the SUV spun out of control, crossed both northbound lanes and hit a guardrail in the median. It then went into a violent spin and went down a 40-foot embankment, ending up partially in a river. The victim, who was riding in the center of the back seat, was thrown from the vehicle. The driver of the Durango did not stop.

The driver and another passenger were treated at Northern Hospital of Surry County and released. The two other passengers remain hospitalized at Wake Forest Baptist Medical Center.

The North Carolina Injury Lawyer Perspective:

The trooper investigating the accident told reporters that no charges will be filed against the driver of the SUV and that they are looking for the driver of the Durango. We hope law enforcement is successful in that search and the driver is held accountable for this awful tragedy. The family of the victim should also seek advice from a North Carolina wrongful death attorney to find out what damages they may be entitled to for their pain and loss.
