A family in South Carolina who has been devastated by a fatal November 2014 drunk driving wreck this week filed a wrongful death lawsuit. The plaintiffs are the suspect that allegedly was driving drunk that night, as well as the two bars that served him
The family of a 22 year-old man who died in the wreck retained a wrongful death attorney in Anderson SC. The suit alleges that the Hooter restaurant and Bench Sports Bar in that town were violating what is called the Dram Shop Act when they served alcohol to the suspect. He has been charged with three counts of felony driving under the influence involving death and felony driving under the influence involving great bodily injury.
The complaint further notes that both establishments knew that the suspect was operating a vehicle and would do so when he left. The document states that neither offered the man alternative transportation when he clearly was intoxicated, according to witnesses.
The lawsuit states that the family of the deceased has suffered financial loss, pain and suffering and loss of companionship. The plaintiffs are seeking damages of at least $10 million.
