It depends on if we can prove the driver was negligent. However, just because a truck caused an accident on the road doesn’t necessarily mean the driver was negligent. The accident may have been caused by avoiding another car, or because of some other issue beyond the driver’s control.

Proceeding only against the truck driver is not the only course of action. There may be other potential parties at fault, such as the trucking company, a contractor of the trucking company, the employer, or the manufacturer or distributor of a faulty truck part. When a trucker is driving for his employer, the employer is automatically responsible. In addition, the driver is responsible for any negligent or careless conduct.
