Should I just deal directly with the insurance adjuster?

In a word – no. Why? Because the insurance company employs really good actors. What I mean is, the insurance adjusters do a great job at convincing you that they are on your side.  Unfortunately, it’s just not true.  Never lose sight of the fact that the insurance company is working against you.  The only job of the adjuster is to get your case settled or resolved for as little money as possible.  This is why the adjusters take advantage of injured people who are not represented.  They ask for a recorded statement, when they may not need it.  They ask you to sign forms giving them full access to your medical history, which they are not entitled to.  Do yourself a favor, call us.  Call us first.  Don’t be fooled by the adjuster.

Should I stay at home to rest and recuperate or seek qualified medical care?

Client 1 comes to our law firm several weeks after their car accident injury and explains that besides one visit to the emergency room they rehabilitated by staying at home for two weeks to mend their body. Client 2 goes to the emergency room, is told to follow up with their family doctor, does so, and the family doctor refers that victim to an appropriate specialist and for other physical therapy. All other things being equal the second client will be paid a more significant sum for their personal injuries than the client who rested their bones for two weeks at home.
Insurance adjusters are simply trained to look for qualified medical care and documentation, as well as the expenses associated with it. Client 1 will receive inadequate compensation if injured the same as client 2, because there is no qualified documentation of the significance of the injuries following the emergency room visit, especially assuming that no doctor issued a note saying that client 1 should remain off of work for the two-week period. Documentation, evidence, expenses always trump the injured clients “word” that they were hurt and could not get up off the couch.

MY doctor says my injuries are from before the wreck but it never gave me problems before, does this mean my case is worth less?

Many times, we have pre-existing conditions that we do not know about or just haven’t bothered us too much.  A car wreck can irritate this condition and make it more bothersome and noticeable.  In Virginia like many states, you are legally entitled to compensation for aggravation of an existing injury.  It wouldn’t be fair for the insurance company to say that because you suffered from an ailment before, they are not responsible for making it worse.  Often this scenario will make the case a little more difficult but a good lawyer knows how to handle this issue.  It is a matter of proving that the injury did not give you trouble before the wreck.  If we can prove that than the injury should not impact your case too severely.
