  • How much time do I have after a trucking accident to file a lawsuit?

Every state contains "statutes of limitation," which determine the amount of time you have to file a personal injury lawsuit. This deadline is important since if you miss it, your claim will be dismissed. The window of opportunity starts from the date of the accident. To determine how much time you have to file your suit, contact Shapiro & Appleton& Duffan immediately and we discuss the pertinent details of your case.

Even if there is an extended period of time before a lawsuit has to be filed, that does not mean you should wait to contact an attorney. There are many details that need to be dealt with as quickly as possible. For example, you want to document your injuries, secure evidence, identify possible responsible persons, and determine insurance policy coverage along with policy limits as soon as you can.

  • How much time does it take to resolve a truck accident case? Do most cases settle or go to trial?

The amount of time required to resolve your case depends largely on the unique circumstances of your case. Some cases take a few months to resolve, while others take a year or longer. Due to the extensive amount of damages involved in a typical truck accident case, the trucking company insurers are more likely to authorize a time-consuming, vigorous defense. This usually means truck accident cases take longer to resolve than typical car accident cases.

  • A big rig went out of control on the road, caused a major accident, and I was injured. Can I recover against the driver of the big rig?

It depends on if we can prove the driver was negligent. However, just because a truck caused an accident on the road doesn't necessarily mean the driver was negligent. The accident may have been caused by avoiding another car, or because of some other issue beyond the driver's control.

Proceeding only against the truck driver is not the only course of action. There may be other potential parties at fault, such as the trucking company, a contractor of the trucking company, the employer, or the manufacturer or distributor of a faulty truck part. When a trucker is driving for his employer, the employer is automatically responsible. In addition, the driver is responsible for any negligent or careless conduct.

An experienced attorney, like those who work for Shapiro & Appleton& Duffan will guide you through the legal process and determine how to proceed with your case.

  • Is the law applying to a car and truck wreck case different from a car injury case and how?

There are many parts that are the same, but evidence law applying to interstate trucking is vastly more complicated.  For example, federal motor carrier safety laws apply to trucking.  There are many insurance regulations governing trucking.  The law of statutes of limitations usually, not always, is governed by state laws.  Please review our practice area (trucking injury) for extensive discussions of car/truck accidents/collisions.  Our firm has handled major injury cases involving trucks and tractor trailer crashes, for example review our case result section on this website.
