If you file a Virginia personal injury lawsuit, the insurance company for the defense may request you to undergo what is called a defense medical examination. Our personal injury attorneys will usually agree to our clients undergoing this examination; if we do not agree to do so, the defense may file a motion with the court for you to be examined by a medical professional for the defense. You are required to attend the medical examination if there is a court order. The insurance company will choose a doctor to conduct this medical examination to make a determination about the nature and extent of your injuries. This examination usually results in a report that is not helpful to your claim, but this examination can be rebutted by a medical examination by your doctor.
