A mother is taking a West Virginia hospital to court for wrongful death after she alleged that the medical staff failed to save her infant daughter’s life in the wake of a serious burn accident.
According to the West Virginia Record, Rebekah Suzanne Cox has filed a WV wrongful death lawsuit against the Marshall University Board of Governors, who run the Marshall University medical school. She believes the hospital is responsible for her daughter’s death and that her daughter would still be alive if the doctors had offered reasonable care.
Two years ago, in the winter of 2009, Cox brought her infant daughter, Shayla Joli Mullins, to the Cabell Huntington Hospital. The baby had been badly burned in a fire that took place in her home earlier that day and was in serious condition.
The wrongful death lawsuit states that an ultrasound taken of the 16-month-old baby revealed a dangerous vein thrombus. While one of the doctors noted the issue, a treatment was never recommended and no follow-up took place. Cos believes that other doctors put in the same position would have acted differently and that her baby’s doctors were negligent in their treatment.
The five doctors listed in the wrongful death suit are doctor Curtis W. Harrison, doctor William James Haberlin, doctor Eduardo Pino, doctor Jay Lakhani and doctor Farid B. Mozaffari. The lawsuit was filed in West Virginia Southern District Court. Cox did not list the amount of compensation that she is seeking.
