Continuing Treatment Rule - Important Info You Need to Know

Virginia adheres to a legal doctrine known as the “continuing treatment rule.” Basically, this rule offers a claimant the ability to extend the statute of limitations period to pursue a civil claim against a negligent doctor, physician, or other medical provider. The continuing treatment rule states that if there has been substantially uninterrupted treatment, then the clock for the statute of limitations begins to run on the date of last treatment, as opposed to the date when the harm occurred.
