My partner Rick Shapiro has just written an article highlighting what is good and bad about the Virginia personal injury law/tort system, which arises from Forbes Magazine declaring Virginia the “best for business” state in the United States. Virginia follows the ancient contributory negligence rule of law (one of only 5 jurisdictions left), and has both a medical malpractice and punitive damages cap. Does Virginia need to level the playing field back toward personal injury victims?
