Rail Workers’ Medical Record Privacy Is Protected by Federal Laws

In his latest post to our firm’s Railroad Accident/FELA Lawyer Blog, my colleague Rick Shapiro reports on announcement by BNSF Railways that it has rescinded a policy that required all employees to turn over doctor’s notes, hospital discharge reports and diagnostic test results for medical issues completely unrelated to their employment or work performance. The railroad company was facing a federal investigation for violating laws that ensure privacy for medical records.
