Jogger Hit and Killed by SUV in Wilmington, NC | Shapiro, Washburn & Sharp

When someone goes jogging, he or she expects to get some exercise, not to get hit by a car. Unfortunately, that happened to a man in Wilmington, North Carolina (NC). He was hit and killed by an SUV at the intersection of Gordon and North College roads by an SUV driver who reportedly ran a red light.  

My colleagues and I sendour deepest sympathies to the victim’s family. Losing a loved one is never easy, but the pain is even worse when the loss is sudden and occurred in an accident that could have been prevented.  

We do not know what exactly caused the at-fault driver to run the red light. Was the person distracted in some way? Was there a mechanical issue? All we know at this time is that the at-fault driver was charged with misdemeanor death by motor vehicle.  

The family of the victim should consult with a wrongful death attorney in North Carolina. When an injury or loss of life occurs because of another person’s negligent or wanton conduct, most courts allow plaintiffs in a wrongful death civil lawsuit to pursue punitive damages. This is a form of compensation that is meant to send a signal to the community that the defendant’s actions will not be tolerated.
