North Carolina Caps Noneconomic Damage Awards in Some Medical Malpractice Cases | Shapiro, Washburn & Sharp

In his latest post to our law firm’s Northeast North Carolina Injuryboard blog site, my medical malpractice attorney colleague Jim Lewis upbraids lawmakers in the Tar Heel State for enacting legislation that caps pain and suffering awards for patients injured or killed by mistakes or errors in hospital emergency rooms. Jim notes – again – that limiting patients’ ability to receive fair compensation from doctors, nurses, pharmacists or hospitals whose negligence harmed them does nothing to achieve the stated purpose of lowering overall health care spending.
