WHAT HAPPENED:
In this Virginia personal injury case involving a tractor-trailer, our client, a doctor, was operating his vehicle on I-264 in Virginia Beach, VA, in January of 2023. The tractor-trailer driver improperly changed lanes, striking another vehicle that spun out of control and struck our client’s vehicle.
The tractor-trailer driver admitted fault in connection with the accident. Our client sustained a traumatic brain injury (TBI), which affected his ability to perform his duties as a physician. The insurance for the tractor-trailer company maintained a single limit liability policy, which required that all legal matters, including both property and personal injury claims, be settled for a figure not exceeding $1,000,000.00. In addition to the property damage claims of both drivers affected by the negligence of the tractor-trailer driver, the other driver sustained personal injuries and made a claim to recover for those injuries.
LEGAL STRATEGY:
Due to the limited coverage, Mr. Sharp filed a suit to protect his client from another plaintiff, who claimed they were entitled to the majority of the insurance coverage due to negligence by the tractor-trailer driver. Suit was filed, and Mr. Sharp also kept in close contact with our client’s medical providers to ensure that the insurance company and its lawyer were aware of the serious nature of his injury. Mr. Sharp also retained an expert to offer testimony regarding the effect of our client’s injury on his medical practice.
